The Attorney-General is set to institute a committee to decide whether or not the State should prosecute Deputy General Secretary of the opposition National Democratic Congress (NDC), Koku Anyidoho over his alleged treasonable comments.

The A-G is yet to make a firm decision on the matter following the submission of the docket on the case to the Department, Deputy A-G, Joseph Kpemka has stated.

“As it has been received, what’s going to happen is that she [A-G] will take a decision, constitute a committee or refer it to one person or two to look at it and then it will be reviewed by yet another group,” Joseph Kpemka told JoyNews.

The NDC leader was arrested on March 27, 2018 by plain-clothed officers from the Criminal Investigations Department (CID), while addressing a news conference at the Ghana International Press Centre (GIPC).

It followed comments he made on radio indicating that President Akufo-Addo will be overthrown just like his father and the late Dr. K. A Busia, due to the ratification of the controversial defence cooperation agreement between the US and the government of Ghana.

“Somebody should tell Nana Addo that history has a very interesting way of repeating itself. On the 13th of January 1972, a certain Colonel Ignatius Kutu Acheampong led an insurrection that removed the progress party from power. Busia was the Prime Minister and Akufo Addo’s father was the ceremonial President. Someone should tell Akufo-Addo that history has an interesting way of repeating itself,” Anyidoho warned.

The outspoken politician was subsequently granted bail after spending 48 hours at the Bureau of National Investigations (BNI).

A docket on the case has been submitted to the A-G but Joseph Kpemka says a committee will be set up to review the docket and advice the A-G on the way to go.

“At the end of the day we will look at the case with a legal eye [to see] whether it is prosecutable, and if it is prosecutable what are the charges that can be proffered…if it is not prosecutable then that is the end of the matter,” the Deputy A-G indicated.
